Treasurer's Report
The Treasurer's report showed balances as of May 6, 2003:
 Operations: $1,979.24.

Status Of Action Items
River Day was a success. Linda Edson expressed great disappointment at the turnout from the Board. The financial results are not available yet.
Public Comment
There was a lively public comment led off by James Crocker of the COMM Prudential Committee who presented the reasons for the COMM Special Meeting scheduled for May 20th. Other contributors to the discussion included Carl Riedell, Town Council and COMM Water Commission, Gary Blazis Town Council, Robert Smith Town Attorney, and several others.
Mr. Crocker quoted at length from several documents (extracts are in the Secretary's file) including the archives of the Cape Cod Times, the minutes of the Prudential Committee, the Horsley Witten report, the Tighe Bond report, the K-V Associates report, the Local Comprehensive Plan, the Cape Cod Commission Act, and the Compact of the Cape Cod Conservation Trusts.
In summary, the Prudential Committee is requesting approval of the taking, by eminent domain if necessary, from the Town of Barnstable, of approximately 35 acres on Old Mill Road in Osterville (known to many as the Darby property.) The Town of Barnstable has earmarked this property as the site for about 85 units of affordable housing.
The proponents say they believe the Town has not fully understood or acknowledged the need for COMM to protect existing water supplies and develop new ones in order to support the anticipated future growth in population. The COMM Water Commissioners have determined that the water district does not need the Darby property and that they can meet future demand for water without the property.
The Town has stated they believe this to be an effort to stop the development of affordable housing on the property, and the Town Counsel quoted citations of previous court decisions where similar efforts in other communities which had the side effect of stopping affordable housing have been denied on the grounds of violations of civil liberties.
The COMM warrant does not state the cost to the tax payers of acquiring the property but the Town paid approximately $7,500,000 about 20 years ago so, unless the Town change their position and donate the land to COMM, it could be several million dollars.
The Prudential Committee will address the cost issue at the Annual General Meeting. (Note: the AGM was adjourned to June 17th., after a large crowd of attendees overwhelmed the meeting place but the Cape Cod Times reported the Prudential Committee believe the land will cost $4 million.)
Old Business
DPW Director Mark Els will schedule regarding the Burgess House parking lot. Representative Perry has pushed the Massachusetts DPW on the issue of the routes 149/28 intersection and the Mass DPW have agreed to reconsider it.
