Marstons Mills Village Association

Call To Order And Welcoming Remarks
The President called the meeting to order at 7:00 PM.
Minutes Of Last Meeting
The minutes of the last meeting were accepted.
With the clarification that (#6, B) the Barnstable committee has already been formed and that he will not be taking part in it. Leah Curtis helpfully reviewed the steps needed to volunteer for future committee assignments.
Treasurer's Report
The Treasurer's report was accepted.
 With the transfer of $10 of the membership funds earmarked for the Scholarship Fund.
Correspondence
 The water quality report pamphlets were received (are available at the Burgess House). Water quality is good. An update form for the MMVA was sent back to the Barnstable Patriot .
Public Comment
None.
Town Council Report
Janice Barton and Leah Curtis were present.
 The PILOT (Payment in Lieu of Taxes) Report is written and being reviewed by the Council.
 Affordable Housing - changes may be coming at the state level which bear watching. The Governor is considering shifting the funding source for the program.
 The Housing Committee is looking for interested members.
 There will be a referendum on the split tax rate on the ballot this fall.
 Janice is looking for nominations for the Jan Eschbar (community service) Award. 6) The Town is starting up a “No Place for Hate” program.
Old Business
McShane Matter of the Downing of the Oak Tree:
 Al Baker read a draft of the public letter to the Board. In it, we will state the consensus that Mr. McShane should publicly admit he made a mistake in cutting down the oak and publicly apologize.
We should stress that he should be encouraged to make an in kind contribution to atone for the harm done. (Not a fine - this has legal implications).
Also, from our standpoint, the contributions need not be trees, nor even landscaping, as new, small trees will, in our opinion, not contribute to the beauty or safety of the intersection. Other needs of the community, such as the contribution of labor to the restoration of the Burgess House barn, should take precedence.
Jackie Etsten then met with us re. the McShane matter and also a review of the Marstons Mills portion of the draft of the LCP:
McShane: Ms. Etsten stated the Town's concern that too many opinions directed at Mr. McShane might make it difficult to induce him to agree to any one contribution. And, the tree warden and Town are of the opinion that, as the harm was done on the corner, the improvements levied on Mr. McShane should also be spent on that corner.
The Board reiterated our opinion that the harm is done on the corner, and cannot be undone with small trees in the area. Rather, a meaningful contribution to the village is both warranted and appropriate, and is best addressed through needs elsewhere in the village.
After discussion, Craig Larson and Al Baker (and other representatives of the MMVA if interested) will meet with Roy from the Town and explore how best to resolve the matter.
LCP: Proposed edits to the draft were reviewed and highlights included:
 Deferring the status of the zoning surrounding the Transfer Station to ongoing negotiations rather than taking a definite stand in the Plan.
 1-172/1-175 - expanding on the idea that mixed use areas already fully developed as residential should be rezoned as such. And, making this a “priority”.
 1-181 - re-engineering the intersection in front of the Cash Market to make it safer with the use of stop signs and other traffic calming devices.
 1-194 - reinforced the opinion that the MM Elementary Building ought be retained for the public use of the village if it is decommissioned.
 Jackie would like use to meet when the final changes to the draft are made and give them our approval.
Subcommittee Reports:
Burgess House: Brian Lobdell has made up a letter listing a subdivision of the tasks needed to restore the barn and the house.
River Day: 15th (Sunday) of May.
Village Day: First Sunday after Labor Day.
Membership: A “dear friend” letter has been made up, Xeroxed, and is available to the Board to start sending out. This month 24 renewals and one new membership were received.
Newsletter: No news.
Scholarship: No news.
Local Comprehensive Plan: See old business above.
Herring Run: No news. No work ongoing due to the wintry weather.

None.
Adjournment
The meeting was adjourned at 9:37 pm. The next public meeting will be March 1, 2005. The next meeting for the Board will be January 18, 2005 to discuss the mailing list and speakers. Both are at 7 pm at the Burgess House.
